REGULAR MEETING OF NOVEMBER 2, 2004

 

 

Be it remembered that the Mayor and Board of Aldermen of the City of Ocean Springs met in a Recess meeting at City Hall in the City of Ocean Springs at 6:00 p.m. on November 2, 2004. Mayor Seren Ainsworth, presiding; Aldermen, Jalanivich, Lloyd, Cody, Carvin, and Dalgo and Gill, were present. Alderman McDonnell and Attorney John Edwards were absent. Matt Lott from the Dogan & Wilkerson Law Firm represented the city due to Attorney Edwards’ absence.  

 

Alderman Cody gave the Invocation.

 

Mayor Ainsworth led the Pledge of Allegiance.

 

Mayor Ainsworth proclaimed November 2, 2004 as Travis Scharr, Alex Scharr, Bradley Dale and Daniel Lorraine Day for their fund raising efforts on behalf of the Mary C. O’Keefe Cultural Center.

 

Mayor Ainsworth also recognized several members of Boy Scout Troop 271. They were Andy Hill, Bradley Champine, Andrew Peterson, and Chandler Curtis who were working on the Citizenship in the Community Merit Badge in Communications under troop leader David Hill. Scout leaders Jim Curits and Tommy Peterson were also present.

 

Consent Agenda

 

A motion was made by Alderman Jalanivich with a second by Alderman Carvin to approve the Consent Agenda except item b which is the Claims Docket. The motion carried unanimously.

 

A motion was made by Alderman Jalanivich with a second by Alderman Carvin to remove item 3 on the Claims Docket. The motion carried unanimously.

 

DEPARTMENT REPORTS

 

City Clerk

 

A motion was made by Alderman Lloyd with a second by Alderman Jalanivich to approve part-time janitorial positions for City Hall and for the Police Department and authorize appropriate steps to fill the janitorial positions. The motion carried unanimously. (Exhibit 5-a)

 

A motion was made by Alderman Jalanivich and a second by Alderman Gill to approve the Ocean Springs Museum Commission’s request to expand the Commission from five members to seven members. The motion carried unanimously. (Exhibit 5-b)

A motion was made by Alderman Jalanivich with a second by Alderman Carvin to appoint Maralou Hutto and Joseph B. Garrard to the newly created membership of the Ocean Springs Museum Commission, per the Commission recommendation. The motion carried unanimously. (Exhibit 5-b)

 

A motion was made by Alderman Lloyd with a second by Alderman Jalanivich to table the Moran, Seymour & Associates, Inc. invoice discussion. The motion carried unanimously.

 

Police Department

 

A motion was made by Alderman Gill with a second by Alderman Carvin to approve payment of $10,560.00 (budgeted) Animal Shelter fees for FYE 9/30/2005 to Jackson County (Exhibit 5-d).

 

Risk Manager/Human Resources

 

Alderman Jalanivich made a motion with a second by Alderman Carvin to allow an Ocean Springs high school student to work with the Risk Manager/Human Resources Department as part of the High School Internship Program. The motion carried unanimously.

 

MAYOR’S REPORT

 

Moratorium on Demolition of Buildings

 

The Historic Preservation Commission has made recommendations concerning older buildings in the City, causing an amendment to the Ocean Springs Building Code Section 7-154 to read as follows:

 

          Any building that has been previous nominated by the Ocean Springs Historic Preservation Commission or the Mississippi Department of Archives and History as an individual site, property or landmark is subject to review by the Ocean Springs Historic Preservation Commission prior to the issuance of any demolition permits.

 

          Any primary structure that is not included in the above statement, and is in excess of (50) years in age is subject to review by the Mayor and Board of Alderman prior to the issuance of any demolition permits.

 

Alderman Lloyd asked about notifying the public. City Planner Scuggs stated notification was not necessary as the process require going through the Historic Preservation Commission meaning that citizens will have an opportunity to discuss their particular situation.

After discussion that included clarification that the public is notified through a newspaper ad, a motion was made by Alderman Jalanivich with a second by Alderman Carvin to accept the recommendations of the Community Development and Planning Department to amend the Ocean Springs Building Code Section 7-154. The motion carried unanimously.

 

In light of the amendment to the Ocean Springs Building Code a motion was made by Alderman Jalanivich with a second by Alderman Gill to remove the moratorium on demolition of buildings. The motion carried unanimously.

 

Martin Luther King, Jr. Birthday Activities 2005

 

A motion was made by Alderman Jalanivich with a second by Alderman Carvin to place a $500.00 advertisement inside the front or back page of the Souvenir Booklet for the Dr. Martin Luther King, Jr. Birthday Celebration with the payment made by an even disbursement from each Alderman’s fund. The motion carried unanimously.

 

Appointment to the Citizens Education and Outreach Panel

 

Mayor Ainsworth asked that the Board recommend a citizen for the Citizen Education and Outreach Panel to review the Solid Waste Management Plan. He asked that the recommendation be made by the November 16, 2004 meeting.

 

2005 Gulf Coast Legislative Reception Contribution

 

A motion was made by Alderman Jalanivich with a second by Alderman Cody to approve a $500.00 contribution to the 2005 Gulf Coast Legislative Reception for the legislative reception held Wednesday, January 12, 2005 at the Trade Mart Building in Jackson, Mississippi. The motion carried unanimously. Alderman Lloyd questioned where funding would come from and was told that if would come from the miscellaneous promotions fund. (Exhibit 5_g)

 

ALDERMEN’S FORUM

 

Alderman Jalanivich would like to make a monument at the Caboose honoring Ocean Springs families who have worked for the railroad. His plans are to have a sign, a wrought iron fence, a marble monument and landscaping. He does not have a price for the project at this time, but will spend from his discretionary fund. He asked that citizens call Sue Ray in the Mayor’s office with railroad family names. 

 

HEARING FROM THE PUBLIC

 

Alderman Jalanivich recognized his daughter, Leah, who was in the audience as part of a community service class.

 

Reverend Jessie Trotter asked to discuss a problem with the Martin Luther King, Jr. Park. There are individuals that are gambling and dealing drugs in that area and he would like to make the park safer for the children. He said it is too dark in that area and would like to have a light in the park area.

 

Alderman Gill made a motion with a second by Alderman Jalanivich to place a light on the street that would serve the park. Alderman Lloyd and Alderman Cody stated they would meet Rev. Trotter the following evening to determine where the light should be place. The motion passed unanimously.

 

At 6:30 Alderman Jalanivich made a motion to go into Closed Session to determine if the Board would stay in Executive Session. The motion carried unanimously.

 

Alderman Lloyd made a motion with a second by Alderman Jalanivich to stay in Executive Session to discuss matters of personnel in the Police, Planning, and Fire Departments. The motion carried unanimously.

 

At 7:05 Alderman Cody made a motion with a second by Alderman Jalanivich to return to regular session.

 

After Executive Session, Alderman Cody made a motion with a second by Alderman Lloyd to hire Michael Harrison as a Building Official in the Community Development and Planning Department. His salary will be $36,000.00 per year plus $720.00 for education, after that information is documented. Included in the motion is to extend his probationary period until September 30, 2005. Alderman Jalanivich abstained. The motion carried.

 

Alderman Cody made a motion with a second by Alderman Lloyd to hire Gregory Wilson as the Code Enforcement/Assistant Building Official in the Community Development and Planning Department. His salary will be $33,000.00 and contingent upon the successful completion of pre-employment screening. Included in the motion is to extend his probationary period until September 30, 2005. Alderman Jalanivich abstained. The motion carried.

 

City Planner Scruggs recommended that both Michael Harrison and Gregory Wilson begin employment on November 8, 2004.

 

Alderman Carvin made a motion with a second by Alderman Jalanivich to recess until Tuesday, November 16, 2004 at 6:00 p.m. The motion carried unanimously.
