A Special Call Meeting of the Mayor and Board of Aldermen of the City of Ocean Springs was called to order by Mayor Ainsworth at 7:00 p.m. on August 8, 2002, at City Hall in the City of Ocean Springs. Present were Aldermen Jalanivich, Lloyd, McDonnell, Cody, Carvin, Dalgo and Gill, City Attorney Oscar Jordan and City Clerk Adrienne Howell.
Motion by Cody, seconded by Gill, to recess until 7:40 p.m.

The Special Call Meeting was called to order again by Mayor Ainsworth at approximately 7:40 p.m. Present were Aldermen Jalanivich, Lloyd, McDonnell, Cody, Carvin, Dalgo and Gill, City Attorney Oscar Jordan and City Clerk Adrienne Howell.
Mayor Ainsworth read aloud the following Special Call:

Motion by Jalanivich, seconded by McDonnell, to go into Closed Session to determine the necessity for an Executive Session.

VOTING NAY Aldermen Carvin and Dalgo
Alderman Dalgo stated he did not feel an Executive Session was necessary.
Motion by McDonnell, seconded by Jalanivich, to go into Executive Session to discuss potential litigation.

The City Clerk announced to the audience that the Board had elected to go into Executive Session to discuss potential litigation.
Shortly after the Executive Session began, the City Attorney left the session and Pete Benjamin of ADP was asked to join the Board, remaining approximately 40 minutes. Following Mr. Benjamin’s return from the Executive Session, the City Attorney rejoined the Board. The City Clerk was then asked to join the Board, followed by the Human Resources Director, each remaining less than 10 minutes.
The Executive Session ended after approximately 1½ hours.
Motion by Dalgo, seconded by Gill, to resume the Regular Session.

Motion by Cody, seconded by Gill, to terminate the services of ADP because of the inability of ADP and the City of Ocean Springs to effectively correlate, effective October 31, 2002.
