RECESS MEETING OF OCTOBER 13, 1999

A Recess Meeting of the Mayor and Board of Aldermen of the City of Ocean Springs was called to order by Mayor Ainsworth at 6:00 p.m. on October 13, 1999, at City Hall in the City of Ocean Springs. Present were Aldermen Jalanivich, Garrard, McDonnell, Cody, Cosper and Gill, and City Clerk Adrienne Howell. City Attorney Oscar Jordan was absent and Alderman McKay was temporarily absent.

Alderman Cody gave the Invocation.

Mayor Ainsworth led the Pledge of Allegiance.

Motion by Cody, seconded by McDonnell, to go into Closed Session to determine the necessity for an Executive Session.

VOTING AYE Aldermen McDonnell, Cody and Gill

VOTING NAY Aldermen Jalanivich, Garrard and Cosper

TEMPORARILY ABSENT AND NOT VOTING Alderman McKay

There being a tie vote, Mayor Ainsworth voted AYE and the motion carried.

Motion by Cody, seconded by McDonnell, to go into Executive Session to discuss potential property acquisition and excuse the City Clerk.

TEMPORARILY ABSENT AND NOT VOTING Alderman McKay

The City Clerk announced to the audience that the Board had elected to go into Executive Session to discuss potential property acquisition.

Alderman McKay was present for the meeting at 6:15 p.m. and joined the Board in Executive Session.

After approximately 40 minutes the Executive Session ended and the following motion was made:

Motion by Cosper, seconded by McDonnell, to resume the Regular Session.

VOTING NAY NONE

Motion by Gill, seconded by Cody, to purchase the 4.5 acre property owned by Alice T. Austin and Alice Martin adjacent to the east side of the Ocean Springs Civic Center at a total cost of $200,000.00, with a down-payment of $75,000.00 and the $125,000.00 balance paid at contract closing.

VOTING AYE Aldermen McDonnell, Cody, Cosper and Gill

VOTING NAY Aldermen Jalanivich, Garrard and McKay

The motion carried.

Motion by McDonnell, seconded by Cosper, that the closing date be set at a mutually agreed upon time.

VOTING NAY Alderman McKay

Motion by Cody, seconded by Gill, to recess until 7:00 p.m. on October 19, 1999.
